ELIGIBILITY
99 Ranch Market’s Fremont-Warm Springs Store Grand Opening Lucky Draw (the “Lucky Draw”) is open only to legal residents of Northern California and at least 18 years of age at the time of entry. Employees (and their immediate families) of 99 Ranch Market, Welcome Market, Inc. and its affiliate and subsidiary companies (collectively referred to as “Sponsor”) are not eligible to enter or win.
TERMS
The Lucky Draw begins on 11/05/2021 and ends on 01/09/2022 during the store business hours of 99 Ranch Market Fremont-Warm Springs Store. All Entries must be received by 01/09/2022 on or before the end of the store‘s business hours. The Lucky Draw is subject to all applicable federal, state and local laws and regulations. Odds of winning all depend on the total number of entries received. Void where prohibited or restricted by law. By entering this Lucky Draw, all entrants agree to comply with and be bound by these Official Rules, and to comply with all federal, state and local laws and regulations. Entrants in violation of the Official Rules will be disqualified.

HOW TO ENTER
There are two ways available for entering the Lucky Draw.
A) In-Store Entry—during the above Lucky Draw Period, entry tickets can be obtained on request and free of charge at the Customer Service counter at 99 Ranch Market Fremont-Warm Springs Store. Limit one entry ticket per person per day.
B) Alternative Method of Entry: please mail us with a self-addressed stamped envelope to request for an entry ticket. Limit one entry ticket per person per request.

The official entry forms must be filled out completely and deposited in the specific drawing box in Fremont-Warm Springs Store during the Lucky Draw Period. Limit one entry per person per day. Incomplete or unclear entries will be voided. Employees of 99 Ranch Market will not provide assistance to fill out or deposit the entry ticket for any participant. The entries for Lucky Draw must be deposited into the specific box during business hours of the above specified period to be eligible for the drawing. Only original and official entry forms are valid. Photocopies or otherwise reproduced forms are not acceptable. Sponsor is not responsible for lost, late, damaged, unintelligible, stolen, incomplete, misdirected, or mutilated entries. All entries become the sole property of Sponsor and will not be returned or acknowledged. Lucky Draw entries that are accompanied by an order for goods or a purchase will not place the entrant at an advantage or make them eligible for additional chances for prizes.
SELECTION OF WINNERS
A preliminary drawing will be conducted publicly on 01/14/2022. Thirty (30) winning entries will be drawn randomly from all entries received. Once a winning entry is drawn, the entry will not be put back to the box for any further drawings. Each of the thirty winning entries of the preliminary drawing is entitled to win one prize in this Lucky Draw. Thirty winners of the preliminary drawing will be invited to the final drawing event that will be held on 02/05/2022. In case any of the winners of the preliminary drawing, who are not able to come to the final drawing on 02/05/2022, will be considered as voluntarily relinquishing their eligibility to win any prize from the Lucky Draw.
During the final drawing, all winners of the prizes will be drawn randomly from the thirty eligible winning entries and will be awarded during the event. Each of the potential winners is entitled to win one prize only. If multiple winning entries belong to any individual, all such subsequent entries will be disqualified. Sponsor reserves the right to disqualify any entrant or winner and may refuse to award any prize to a person who is ineligible or has violated these Official Rules, gained unfair advantage in participating in the Lucky Draw, or obtained winner status using fraudulent means. Actual odds of winning depend on the number of eligible entries received during the Lucky Draw Period.
PRIZES
Please refer to the Prizes List for details. The ARV of the prize value listed is for reference only. Winners will not receive the difference between actual and approximate retail value. There is no cash substitute and prizes cannot be redeemed for cash. No more than the stated number of prizes will be awarded. Sponsor reserves the right in their absolute and sole discretion to substitute any prize of equal or greater value.
The winners will be solely responsible for all taxes (federal, state, and local) and for any other fees or costs associated with the prize they receive. Sponsor reserves the right to withhold and deduct such taxes and charges from the prize if and to the extent required by law. Winners of prizes that value more than $600 must fill out a W-9 form with their SSN information, and provide a copy of Social Security card. 99 Ranch Market is not responsible for any services, maintenance, malfunction, liabilities and responsibilities that are associated with the prizes. It is the prize winners’ sole responsibility to contact the original manufacturer or prize sponsors themselves for any services, maintenance, malfunction, liabilities and responsibilities that are associated with the prizes.
No prize substitutes are allowed except by the sole discretion of the Sponsor. Sponsor reserves the right to substitute a prize (or any part of the prize) with a prize of equal or greater value. Any difference between the stated approximate retail value and the actual value of the Lucky Draw prize will not be awarded. By entering the Lucky Draw, the winner agrees to accept the whole prize. If the winner cannot accept the whole prize, the winner must forfeit the prize and another winner will be chosen.
The winner will be required to complete, execute and return an Affidavit of Eligibility and Liability/Publicity Release at the time of receiving the prizes, except where prohibited by law, and any other additional documents required by Sponsor. Each guest (or his/her parent/legal guardian if he/she is a resident of a jurisdiction that deems him/her to be a minor) will be required to complete, execute and return an Affidavit of Eligibility and Liability/Publicity Release, except where prohibited by law, and any other additional documents required by Sponsor within seven (7) days after receipt by such winner.
RELEASE/WAIVER
By participating in the Lucky Draw, entrants agree, and by accepting prizes, winners agree to release and hold harmless the Sponsor, its officers, directors, employees, agents, and representatives, and its Lucky Draw sponsors (collectively referred to as “Released Parties”), from any and all liability, injury, death, loss or damage, arising in whole or in part, directly or indirectly, incurred by participation in the Lucky Draw and/or the awarding, receipt, acceptance, possession or use/misuse of the prize, prize-related travel, and the winners grant to the Sponsor or their designees the perpetual right, where lawful, to use their name, address (city and state), photos, likeness, voice, biographical information, opinions, statements, facts of their winnings and/or other related information for promotion, trade, commercial, advertising, marketing, and publicity purposes at any time or times, in all media now known or hereafter discovered, nationwide or worldwide, including but not limited to the Internet, without notice, review or approval and without payment or compensation except where prohibited by law.
PRIVACY POLICY
Any personally uniquely identifiable information collected during participation in the Lucky Draw will be collected by the Sponsor. By entering the Lucky Draw, entrants agree to Sponsor’s use of entrants’ personal information in accordance with Sponsor’s Privacy Policy:https://www.99ranch.com/privacy-policy Entrants hereby acknowledge that their personal information collected by Sponsor will be used for administering the Lucky Draw and awarding the prizes, and to receive additional marketing materials and promotional messages from Sponsor unless entrants opt-out to receive additional marketing materials and promotional messages from Sponsor by emailing the Sponsor at newcustomerservice@tawa.com.
GENERAL CONDITIONS
By participating, entrants agree to comply with and be bound by these Official Rules. Sponsor shall have the sole right to disqualify any entrant from the Lucky Draw for violation of these Official Rules or any applicable laws relating to the Lucky Draw. Entrants further agree to comply with and be bound by decisions of Sponsor, which shall be final and binding in all respects. Sponsor reserves the right at its sole discretion to disqualify any individual it finds to be: (a) tampering or attempting to tamper with the entry process, content or the operation of the Lucky Draw; (b) violating these Official Rules; (c) violating the Official Rules of service, conditions of use and/or general rules or guidelines of any Sponsor property or service; or (d) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Sponsor (i) make no warranty, guaranty or representation of any kind concerning any prize, (ii) disclaim any implied warranty, and (iii) are not liable for any injury, death, losses or damages arising out of any person’s participation in the Lucky Draw or the acceptance and use of any prize and travel thereto or therefrom. All disputes will be resolved under applicable California laws.
GOVERNING LAW/DISPUTES
All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of entrants, Sponsor or the Released Parties in connection with the Lucky Draw will be governed by and construed in accordance with the internal laws of the State of California, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other state’s laws. The parties hereby consent to exclusive jurisdiction and venue of the courts located in Orange County, California in any action to enforce (or otherwise relating to) these Official Rules or relating to this Lucky Draw.
BY ENTERING THE LUCKY DRAW, EACH ENTRANT AGREES THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: (1) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE LUCKY DRAW, OR ANY PRIZE AWARDED, WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (2) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED, (IF ANY), NOT TO EXCEED TWO HUNDRED FIFTY DOLLARS ($250.00), BUT IN NO EVENT WILL ATTORNEYS’ FEES BE AWARDED OR RECOVERABLE; (3) UNDER NO CIRCUMSTANCES WILL ANY ENTRANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND ENTRANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, EXEMPLARY, CONSEQUENTIAL OR SPECIAL DAMAGES, LOST PROFITS, AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND (4) ENTRANTS’ REMEDIES ARE LIMITED TO A CLAIM FOR MONEY DAMAGES (IF ANY) AND ENTRANT IRREVOCABLY WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY, SO THE ABOVE MAY NOT APPLY TO YOU.
SEVERABILITY
If any provision(s) of these Official Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.
MODIFICATION
Sponsor reserves the right to change or modify the rules and terms without further notification. Sponsor reserves the right, at its sole discretion, to cancel, modify, postpone, delay, suspend and/or terminate the Lucky Draw in whole or in part.
